1. Acceptance of Terms
By accessing or using KidzTale's website, applications, or services (collectively, the โServiceโ), you agree to be bound by these Terms of Service and by our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, do not use the Service. These Terms constitute the entire agreement between you and KidzTale regarding the Service and supersede any prior agreements. If you are using the Service on behalf of a household or organization, you represent that you have the authority to bind that household or organization to these Terms. 2. Description of Service
KidzTale provides an AI-powered platform for creating personalized children's storybooks. The Service allows you to create custom stories featuring your child as the main character, with AI-generated illustrations. Stories can be downloaded as digital PDFs and, where available, printed and shipped. See our pricing page for current product offerings, and about for more on how the Service works.
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Be at least 18 years old or have parental consent
- Accept responsibility for all activities under your account
- Notify us promptly of any unauthorized access
4. User Content
When you upload photos or provide content to create stories, you:
- Retain ownership of your original content
- Grant us a limited license to use the content solely to provide the Service to you
- Confirm you have the right to use and share the content (e.g., it depicts your own child or a child whose guardian has consented)
- Agree not to upload inappropriate, infringing, or illegal content
5. Purchases and Payments
Story credits and subscriptions are processed through Stripe. By making a purchase, you agree to:
- Pay all applicable fees and charges
- Provide valid payment information
- Accept that purchased credits remain valid for use as long as your account is active
6. Refund Policy
We offer a 30-day money-back guarantee on unused credits and recent purchases. If you're not satisfied with your purchase, contact us within 30 days for a full refund of unused credits, processed to the original payment method. Credits already redeemed for a generated storybook are non-refundable, but if a generation fails or produces a defective result we will regenerate it or refund that credit at no charge.
7. Intellectual Property
The KidzTale platform, including its design, features, software, and content (excluding user content and the specific storybooks generated for you), is owned by KidzTale and protected by intellectual property laws. The personalized storybooks you generate are licensed to you for personal, non-commercial use; you may print, gift, and share them with family and friends but may not resell them or use them in commercial advertising. Commercial licensing may be available on request.
8. Prohibited Uses
You agree not to:
- Use the Service for any illegal purpose
- Upload content that infringes on others' rights
- Upload photos of children whose parent or legal guardian has not consented
- Attempt to reverse engineer or hack our systems
- Resell or commercially exploit the Service without permission
- Upload inappropriate, offensive, or harmful content
- Use the Service's outputs to train competing AI models
9. AI-Generated Content
Our stories and illustrations are generated using artificial intelligence. While we strive for quality, AI-generated content may occasionally produce unexpected results. We continuously improve our systems to provide the best experience.
10. AI Training Opt-Out
KidzTale does not use photos, names, or any other content you upload to train, fine-tune, or improve AI models. This applies to KidzTale's own systems and is required of every third-party AI provider we work with under written contract. There is no opt-in toggle because there is no opt-in โ user uploads are never used for model training. See our Privacy Policy for full detail.
11. Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by law, KidzTale and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid KidzTale in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100), whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitations on certain damages, so some of the above limitations may not apply to you.
12. Termination
We may suspend or terminate your account if you materially violate these Terms, including by uploading prohibited content, abusing refund policies, or using the Service in a way that risks harm to others. We will, where reasonable, notify you and provide an opportunity to cure. You may also delete your account at any time from your account settings or by emailing support. Upon termination, your right to use the Service ceases immediately; downloadable storybooks already generated remain yours under the license described in Section 7. Sections that by their nature should survive termination โ including Intellectual Property, Limitation of Liability, Dispute Resolution, Governing Law, and Class Action Waiver โ will continue to apply.
13. Changes to Terms
We may update these Terms of Service from time to time to reflect changes to the Service, our business, applicable law, or user feedback. We will notify you of material changes by email or through the Service at least 14 days before the change takes effect. Continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree to the updated Terms, you may stop using the Service and request account deletion. The most current version of these Terms is always available at this URL, and the โLast updatedโ date at the top reflects the latest revision.
14. Dispute Resolution
Before filing a formal claim, you agree to first contact us at legal@kidztale.com and attempt in good faith to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration in the United States under the American Arbitration Association (AAA) Consumer Arbitration Rules. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction. Either party may seek injunctive or equitable relief in court for matters relating to intellectual property, and you may bring an individual claim in small-claims court if it qualifies.
15. Governing Law
These Terms are governed by the laws of the United States without regard to its conflict-of-law principles. Subject to the Dispute Resolution section, United States federal courts will have exclusive jurisdiction over any matters not subject to arbitration.
16. Class Action Waiver
You and KidzTale agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. Unless both you and KidzTale agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding. If this Class Action Waiver is found to be unenforceable, then the entirety of the Dispute Resolution section will be null and void with respect to such proceeding.
17. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be modified, it will be severed from these Terms. The remaining provisions will remain in full force and effect.
18. Force Majeure
KidzTale will not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government action, internet or telecommunications failures, third-party service outages (including cloud, AI, or payment providers), or pandemics. We will use reasonable efforts to resume normal performance as soon as practicable.

Who owns the storybooks I create?
You do. The personalized storybooks you generate on KidzTale are yours to keep, download, print, gift, and share with family and friends. KidzTale retains ownership of the underlying platform, templates, and software, but the specific storybook produced for your child belongs to you for personal, non-commercial use.
Can I use KidzTale stories commercially?
KidzTale storybooks are licensed for personal, non-commercial use only. You can print copies for your family, give a printed book as a gift, or share digital copies with grandparents and close friends. You may not resell KidzTale stories, mass-distribute them, use them as marketing collateral for a business, or use them to train other AI models. Commercial licensing may be available โ contact us if you need it.
What happens to my account if I stop using KidzTale?
You can delete your account at any time from your account settings or by emailing support. Inactive accounts are not auto-deleted, but you can request deletion at any point. After deletion, your generated storybooks and personal data are removed within 30 days. Billing records are retained for seven years to meet US tax law but are not used for any other purpose.
